Good points. I recall the majority of my law professors sending these messages in the seventies: Courts are wise, legislatures are foolish, strict constructionists are hopelessly out of touch, the Warren Court is marvelous, etc.
Don't get me wrong: I don't want either side to have a monopoly on the discussion. It's nice to have enough diverse opinions to have a genuine debate instead of inviting token representation.
